Drivers going 1 mph below speed limit ‘could face jail’ time
A new set of driving laws has imposed stricter restrictions on drivers in Louisiana – including penalties for left-lane drivers traveling one mph under the speed limit.
This means the threshold has been lowered from 10 mph to just 1 mph below the speed limit. Details are included in Act 24 from 2024’s legislative session, which states a third offense punishment as: “A fine of $350 for a third subsequent offense within a twelve-month period of the first offense or imprisonment for not more than thirty days, or both.”
Meanwhile, Louisiana uses a basic rubric for determining speeding ticket fines (much like SC). Without any aggravating circumstances or additional charges, you can expect your speeding ticket for going above the speed limit will follow this basic structure:
$115 for speeding 1-9 mph over the posted speed limit
$215 for speeding 10-14 mph over the posted speed limit
$240 for speeding 15-20 mph over the posted speed limit
More than $240 for speeding 21 mph over the posted speed limit
With all potentially carrying 30 days in jail.
Therefore, if you are paying attention. One mile under the speed limit – $150 fine. One mile over the speed limit $115 fine (with the potential of 30 days jail time). The entire state of Louisiana just became a speed trap. Looks like they have found their new way to fund the state’s government. Why do you need taxes, when you can just arrest everyone that drives through the state. Might as well get rid of the passing lanes, because passing a prima facie evidence of maybe both drivers breaking the law.Law makers keep lawyers in business when they make everyone a criminal. Good thing we do criminal law – so call if you get caught going to slow (or fast).
